Aunque quizás ocurra hoy que lo (...) sensato resulte ser excepcional y nuevo, es lo más conforme al auténtico estilo de un jurista, que, por su profesión, nunca busca destacar por su singularidad, sino por la conveniente edificación crítica del derecho fundado sobre una tradición respetable. Para intentar comprender la visión que Eugenio d'Ors tiene de España a principios de los años 30 del pasado siglo, es necesario entender su biografía. Cuando Eugenio d’Ors deja Barcelona en julio de 1921 solo le faltaban tres meses para cumplir los cuarenta años. A los cuarenta —escribió su hijo Álvaro— lo más normal es que los hombres no cambien ya su caudal de ideas. La originalidad de la época catalana sobre el resto de la producción de d'Ors no significa, (...) sin embargo, un menosprecio de los años posteriores. Fue en gran medida su producción no catalana y su constante actividad y participación en muchos otros proyectos españoles y europeos, lo que hizo que su “gloria catalana” no quedara diluida y que su figura tenga hoy un lugar destacado en las letras españolas. Por todo ello, la exposición está organizada en las tres secciones siguiente: 1) Su biografía catalana; 2) la primera etapa de su biografía castellana, y 3) Su visión de España en los años 30. Some authors have defended the claim that one needs to be able to define ‘physical coordinate systems’ and ‘observables’ in order to make sense of general relativity. Moreover, in Rovelli (Physical Review D,65(4), 044017 2002), Rovelli proposes a way of implementing these ideas by making use of a system of satellites that allows defining a set of ‘physical coordinates’, the GPS coordinates. In this article I oppose these views in four ways. First, I defend an alternative way of understanding general (...) relativity which implies that we have a perfectly fine interpretation of the models of the theory even in the absence of ‘physical coordinate systems’. Second, I analyze and challenge the motivations behind the ‘observable’ view. Third, I analyze Rovelli’s proposal and I conclude that it does not allow extracting any physical information from our models that wasn’t available before. Fourth, I draw an analogy between general relativistic spacetimes and Newtonian spacetimes, which allows me to argue that as ‘physical observables’ are not needed in Newtonian spacetime, then neither are they in general relativity. In this sense, I conclude that the ‘observable’ view of general relativity is unmotivated. (shrink)

This article explains the methodology behind our PhD thesis, that describes how five Southern European Communist parties2 reacted, through their party press, to the events that took place in Eastern Europe from 1989 to 1991, such as the Fall of the Berlin Wall in November 1989, the deposition of the Romanian dictator in December 1989 or the Soviet Coup d’etat in August 1991. We describe an interdisciplinary methodology which combines elements of history of the present, historiography of Communism and communication (...) sciences. We will summarize our study, after explaining our methodology and adapting the framing party press for the purposes of this work. Finally, we’ll draw the conclusions after presenting one specific case: the interpretations provided by each party following the parliamentary elections of June 1989 in Poland. (shrink)

In this study, based in the main political works of D. Fr. Alvarus Pelagius O. Min. (c. 1270- c.1350) we analyze his conception on the origin or efficient cause of the spiritual power and, also, his thought about the finality or final cause of the mentioned power. Referring to the first topic, the Bishop of Silves wants principally refutes some Marsilius of Padua’s thesis contained in the Second Dictio of his Defensor Pacis, completely different of the theology of the catholic (...) priesthood and their hierarchic degrees and the Peter’s Primacy. With this purpose, ad litteram, he bases, between other sources, specially, in James’ of Viterbo OSA De regimine christiano (1301). Concerning the finality of the spiritual power, on the one hand, Alvarus supports the Church’s traditional thought about this matter and, the other hand, by consequence, as member and defender of the hierocratic thought, he defends the thesis according which, in the Societas Christiana, the priests, the bishops and, principally, the Roman Pontiff hold the most important position concerning the secular rulers. This work examines Richard Kilvington's Sophisma 47, in the context of the Doctrine of Obligations. Its aim is to revise the thesis of P. V. Spade, who attributes to Kilvington an intermediate position between Burley and Swyneshed, and interprets the Doctrine of Obligations in general as a Theory of Counterfactuals.

On the one hand, a new classification is proposed of the literary genres of the _Logica Modernorum_, based on the four elements involved in the logical analysis of syncategorematic terms: the meaning of the syncategorem, logical rules, related sophisms, and proposed solutions. On the other, three texts are studied in detail, (...) showing the origins and development of the logical analysis of the syncategorem ‘_an_’ between the 12th and the 13th centuries. Finally, a comparative study is offered of different analyses of the sophism ‘_Tu scis an de mentiente sit falsum Sortem esse illum_’, a sophism that does not raise any problem as to the particle ‘_an_’, but introduces the issue of the truth conditions of the _dicta_. Neste estudo, com base nos principais escritos políticos de D. Frei Álvaro Pais O. Min. (c. 1270-c. 1350) analisamos sua concepção a respeito da origem ou causa eficiente do poder espiritual e, igualmente, seu pensamento no tocante à finalidade ou causa final do referido poder. Quanto ao primeiro tópico, o Bispo de Silves quer principalmente refutar algumas das teses de Marsílio de Pádua contidas na 2.ª Parte do seu Defensor da Paz, completamente opostas à teologia do sacerdócio católico e seus (...) graus hierárquicos e à do Primado Petrino. Para tanto, quase literalmente, haure-se, entre outras fontes, particularmente no De regimine christiano (1301) de Tiago de Viterbo OSA. Com respeito à finalidade do poder sacerdotal, de um lado, Álvaro sustenta a doutrina tradicional da Igreja a seu respeito e, de outro, em conseqüência, como partidário da hierocracia, defende a tese de que na, Societas Christiana, os detentores do poder espiritual, particularmente o Sumo Pontífice, ocupam uma posição mais eminente em relação aos governantes seculares. This paper looks into the contents of the Tractatus suppositionum terminorum by Master Franquera, in the context of the teaching of logic in Salamanca in the fifteenth century. Franquera’s work is characterised by its explicit realist bias and its rejection of Ockhamist theses, i.e., by its recognition of the existence of a natura communis or a universale in re, which is evident in all discussions related to suppositio simplex and the theory of significatio. But, apart from this, Franquera’s discussion of (...) the theory of suppositio stands out as a strange mixture of different doctrines: some of them are derived from thirteenth-century analyses, others from fourteenth-century developments; realist goals are reached by means of instruments that, while not being nominalist, are definitely inspired by terminism. While upholding the theses of realist schools, Franquera adopts the definitions and rules of nominalist authors. (shrink)

Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die Schreiben Schmitts, die (...) sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. Sie sind zugleich ein spannendes Zeitdokument und ein Beitrag zur Geistesgeschichte Deutschlands und Spaniens. (shrink)

This paper examines the analysis of judgements of belief that Wittgenstein offers in 5.54-5.5423 of the Tractatus. We offer an interpretation of these paragraphs wich also pays attention to 5.5423, usually forgotten. In our opinion, this interpretation fits with Wittgenstein's doctrines, and makes clear that such non-genuine propositions are nonsense. These are not, as has sometimes been proposed, the propositions of psychology. This essay offers a biographical presentation of the Spanish philosopher Eugenio d'Ors (1881-1954), paying special attention to his connection with Pragmatism. Against the mainstream philosophies of rationalism and idealism, d'Ors tried to develop a way of thinking in which it might be possible to live. This was his revolution of philosophy or, more precisely, his Keplerian reform of it.

En el siguiente artículo se presenta una investigación filosófica acerca de la conformación ontológica delmundo virtual. Esta es un aporte teórico al debate contemporáneo de la filosofía de la computación sobrela caracterización ontológica de la computación digital y sus productos emergentes, ya que se propone unaaproximación a este campo de estudio desde la perspectiva filosófica de Nicolaï Hartmann. El objetivo principal del presente artículo es explicar la estratificación del mundo virtual a partir de la teoría ontológica de estratos y categorías (...) de Hartmann. Para cumplir con este objetivo se procedió a una revisión crítica del estado de la cuestión de la ontología filosófica de la virtualidad. Luego se procedió a presentar una propuesta de estratificación y categorización denominada ‘La fábrica del mundo virtual’ que es una ontología hermenéutica de la virtualidad digital basada en los postulados de Hartmann. Las principales conclusiones alcanzadas son: i) La emergencia de la realidad del mundo virtual se encuentra constituida de los mismos estratos que conforman la esfera del conocimiento del mundo real: material, orgánico, psíquico y social. ii) La realidad virtual es un producto de la computación que ocurre en la esfera del conocimiento en el que existe intervención de la esfera ideal y de la esfera del mundo real. Boredom is a characteristic of today’s society. At the individual level and at the social level, the Western countries suffer from boredom. There are extrinsic and intrinsic causes that can lead to boredom. In general, the state of boredom is reached when there are no problems to solve, when the profession does not demand our actions, or when we feel disappointed in realizing that the achievements of life do not give us sustained satisfaction over time. Boredom, especially if it becomes (...) chronic, can be considered a negative thing. But it can also have something positive. The silence, stillness and inaction that define boredom are also characteristics that define the initial state of the person before meditation. This study aims to reflect the possibility of getting out of boredom through meditation. We can abandon boredom if we start a path of personal growth through increasing attention and perception; coming out of ourselves, leaving our own reflections and thoughts, reaching personal emptying and a voluntary impoverishment of our exteriority, which opens the door to us to encounter with being.
